  34. Congressional hearings on the Administration's Clipper/Skipjack initiative,
  35. and the FBI's draft Digital Telephony surveillance bill, and their
  36. implications for privacy and First Amendment rights, are to be held
  37. April 27 and May 3, 1994.
  38.  
  39. Sen. Patrick Leahy (D-VT), of the Senate Judiciary's Technology and the Law
  40. Subcommittee, has expressed skepticism of the Clipper encryption scheme,
  41. and has called for hearings to examine the problems of this proposal and its
  42. implementation.  This effort is due in part to all of you who responded to
  43. EFF's grassroots campaign to raise fundamental questions about security and
  44. free speech issues in relation to the White House proposal.
  45.  
  46. The Senate hearing will be held on April 27, 1994, 9:30am EDT, Hart
  47. Building Rm. 216, and should feature testimony from the Digital Security
  48. and Privacy Working Group (a broad coalition of industry and public
  49. interest organizations, headed by EFF), Trusted Information Systems' Steve
  50. Walker, Whitfield Diffie of Sun Microsystems, a representative of the
  51. Justice Dept. (possibly Atty. Gen. Janet Reno), NSA Director Adm. Mike
  52. McConnell, and Ray Kammer of NIST.

  61. Subcommittee on Technology, Environment and Aviation will be holding a
  62. hearing to address related civil liberties issues of both the Clipper
  63. scheme and the FBI "Digital Telephony" proposal, which so far remains
  64. unsponsored. The hearing will be chaired by Rep. Tim Valentine (D-NC), and
  65. is scheduled for May 3, 1994, 1pm EDT, Rayburn Building Rm. 2318.  Witnesses
  66. will include Ray Kammer of NIST, NSA's Clint Brooks, representatives from
  67. industry in a panel that will include USTA and TIA, expert witnesses
  68. Dorothy Denning and David Farber, and EFF's Jerry Berman on behalf of
  69. DPSWG.  FBI appears not to be making a showing.

  72. and legislative proposals dealing with electronic survellance, privacy
  73. and security, ...the adequacy of the Computer Security Act in protecting
  74. goverment computer systems", and "the Administration's proposed Digital
  75. Telephony legislation and decision to promulgate a voluntary federal
  76. encryption standard".

  88. $1.5M budget) seeks an experienced fiscal manager with background in
  89. nonprofit administration.

  91. EFF focuses on public policy and public awareness concerning information
  92. infrastructure, application of law, and protection of civil liberties in
  93. online media.  Future projects may address changes in social fabric and the
  94. meaning of community, and commercial, economic, and international issues
  95. related to new digital technologies.

  134. The Membership Director is responsible for the planning, structure and
  135. development of EFF's membership program.  These duties include:  developing
  136. a goal-oriented, strategic membership plan; regularly reporting progress
  137. and results to EFF's Executive Director and board; and developing a program

  139. program operates within budget.

  182. Earlier this year, NTIA issued a Notice of Inquiry and Request for Comment
  183. from the public on "privacy issues relating to private sector use of
  184. telecommunications-related personal information associated
  185. with the National Information Infrastructure."  The comments will have
  186. bearing on an upcoming National Telecommunications and Information
  187. Administration report "which may make recommendations to the Information
  188. Infrastructure Task Force and Congress in the area of telecommunications
  189. and information policy".
  190.  
  191. Last week, EFF called NTIA asking when their privacy report would be made,
  192. and were told that the scheduling was still somewhat flexible, but that
  193. surprisingly few comments had been received before the March 30 deadline. 
  194. We've worked with NTIA's Carol Mattey to reopen the Request for Comments,
  195. with successful results:

  198. several others, we have decided to formally reopen the record in
  199. NTIA's inquiry on privacy issues for additional comments.

  222. Administration (NTIA) has extended the deadline for filing
  223. comments in its privacy Notice of Inquiry (NOI) to May 23, 1994.

  225.      On February 11, 1994, NTIA published a Notice of Inquiry and
  226. Request for Comments in the Federal Register entitled "Inquiry on
  227. Privacy Issues Relating to Private Sector Use of
  228. Telecommunications-Related Information."  59 FR 6842.

  230.      NTIA has received comments from 30 parties in this
  231. proceeding.  Those comments can be reviewed in NTIA's Openness
  232. Room, U.S. Department of Commerce, Room 4092, 14th St. and

  316. There is a New York Assembly bill, AB10035 pending which would provide for
  317. free online access to NY legislative information.  This information is 
  318. already paid for by NY state taxes, yet currently is available
  319. electronically only through an expensive commercial firm.

  322. the attention of the Internet/Usenet community, collected some contact
  323. information and had this to say about this legislation:

  325.  "A bill was just introduced in the NY Assembly to make public information
  326.  freely and timely available, via "the most-accessible and least-cost
  327.  public network" i.e., the Internet. Bill A10035 was referred to the

  364. bills dealing with online information have already failed this year, two
  365. in Oklahoma, and one in Maryland, due to lack of public input and support.

  448. of personal privacy.  The Clipper chip, export restrictions, the Digital
  449. Telephony proposal - the arguments are numerous and complex, but the
  450. principles are clear.  Who will decide how much privacy is "enough"?

  454. technological means they choose.  However, the government's current
  455. restrictions on the export of encrytion software have stifled the
  456. development and commercial availability of strong encryption in the U.S. 
  457. Rep. Maria Cantwell has introduced a bill (H.R. 3627) in the House that
  458. would liberalize export controls on software that contains encryption, but
  459. needs vocal support if the bill is to make it out of the committee stage.
